Privacy Policy and Consent for Data Usage

Privacy is a matter of trust, and your trust is important to us. We respect your privacy and personal space. Therefore, the protection and legally compliant collection, processing, and use of your personal data are important concerns for us. To ensure your confidence during your visit to our websites, we strictly adhere to legal regulations when processing your personal data. We would like to inform you here about our data collection and usage.

By agreeing to the following privacy policy, you consent to the collection, processing, and use of your personal data by JellyPoolBear, operated by MANUEL W STEPAN / 1060 Vienna, Austria / EU (hereinafter JPB), in accordance with data protection laws and the following provisions.

  1. Data Controller The data controller for the collection, processing, and use of your personal data under the Federal Data Protection Act is JPB. If you wish to object to the collection, processing, or use of your data by JPB according to these data protection provisions or for specific measures, you can send your objection via email, fax, or mail to the following contact details: contact@jellypoolbear.com
  2. Collection, Processing, and Use of Personal Data 2.1 Personal Data Personal data refers to information about factual or personal circumstances of a specific or identifiable natural person. This includes, for example, your name, telephone number, address, and all inventory data that you provide during registration and when creating your customer account. Statistical data collected during the visit to our webshop, which cannot be directly linked to your person, is not included. For example, statistics about the most popular pages on our shop or the number of users visiting specific pages of the JPB shop.

2.2 Customer Account We create a password-protected direct access to the stored inventory data (customer account) for each customer who registers accordingly. Here, you can view data about your completed, open, and recently shipped orders, as well as manage your address data, bank details, and newsletter subscription. You commit to treating the personal access data confidentially and not making it accessible to unauthorized third parties. We cannot accept liability for passwords used improperly unless we are responsible for the misuse. The “stay logged in” function is designed to make your visit to our websites as pleasant as possible, allowing you to use our services without having to log in again each time. However, for security reasons, you will be prompted to enter your password again if, for example, you want to change your personal data or place an order. We recommend not using this function on shared computers. Please note that the “stay logged in” function is not available if you use a setting that automatically deletes stored cookies after each session.

2.3 Collection, Processing, and Use of Your Personal Data Privacy is very important to us. Therefore, we strictly adhere to the legal provisions of the Federal Data Protection Act and the Telemedia Act when collecting, processing, and using your personal data. We collect, store, and process your data for the entire processing of your purchase, including any subsequent warranties, for our service activities, technical administration, and our own marketing purposes. Your personal data is only passed on or transmitted to third parties if it is necessary for the purpose of contract processing or billing, or if you have given your prior consent. As part of order processing, the service providers we use (such as transporters, logisticians, banks) receive the necessary data for order and contract processing. The data passed on in this way may only be used by our service providers to fulfill their tasks. Any other use of the information is not permitted and does not occur with any of our entrusted service providers. For your order, we need your correct name, address, and payment details. We need your email address to confirm receipt of the order and to communicate with you. We also use it for your identification (customer login). Furthermore, you will receive your order and shipping confirmation via your email address. Your personal data will be deleted if legal retention obligations do not prevent it, you have asserted a deletion claim, the data is no longer required to fulfill the purpose pursued with the storage, or its storage is impermissible for other legal reasons.

2.4 Use of Your Data for Advertising Purposes In addition to processing your data for the completion of your purchase at JPB, we also use your data to communicate with you about your orders, specific products, or marketing promotions, and to recommend products or services that may interest you. You can object to the use of your personal data for advertising purposes at any time, either in full or for specific measures, without incurring other than transmission costs at basic rates. A written communication to the contact details mentioned under Clause 1 (e.g., email, fax, letter) is sufficient for this purpose.

2.4.1 Newsletter For sending the newsletter, we use the double opt-in procedure, meaning we will only send you a newsletter by email if you have explicitly confirmed that we should activate the newsletter service. We will then send you a notification email and ask you to confirm by clicking on a link contained in this email that you wish to receive our newsletter. If you no longer want to receive newsletters from us, you can object at any time, without incurring other than transmission costs at basic rates. A written communication to the contact details mentioned under Clause 1 (e.g., email, fax, letter) is sufficient for this purpose. Of course, you will also find an unsubscribe link in every newsletter.

2.4.2 Product Recommendations via Email As a JPB customer, you regularly receive product recommendations from us by email. These product recommendations are sent to you regardless of whether you have subscribed to a newsletter. In this way, we want to provide you with information about products from our range that may interest you based on your recent purchases from us. We strictly adhere to legal requirements. If you no longer wish to receive product recommendations or any promotional messages from us, you can object at any time, without incurring other than transmission costs at basic rates. A written communication to the contact details mentioned under Clause 1 (e.g., email, fax, letter) is sufficient for this purpose. Of course, you will also find an unsubscribe link in every email.

2.4.3 Individual Advertising for You Information we receive from you helps us to continuously improve your shopping experience and make it customer-friendly and individual for you. The information you provide and automatically generated information are used to create personalized advertising tailored to you and your interests. We use existing information, such as email delivery and read confirmations, information about your computer and internet connection, operating system, and platform, your order history, service history, date and time of visiting the homepage, and products you have viewed. We use this information exclusively in pseudonymized form. Analyzing and evaluating this information allows us to improve our websites and online offerings and send you individualized advertising. This means advertising that recommends products that may genuinely interest you. Our goal is to make our advertising more useful and interesting for you. Therefore, analyzing and evaluating the pseudonymized data collected from you helps us ensure that we do not send you random advertising. Instead, we send you advertising, such as newsletters, product recommendations, by email, or postal mail, that corresponds to your areas of interest. In this regard, for example, we compare which of our advertising emails you open to avoid sending you unnecessary emails.

I consent to JPB using the data provided by me, as well as additional information stored in my customer account and pseudonymized usage data, to present personalized advertising and/or special offers and services to me. If you do not want to receive personalized advertising, you can object at any time, either in full or for specific measures. A written communication to the contact details mentioned under Clause 1 (e.g., email, fax, letter) is sufficient for this purpose.

2.4.4 Contests, Market, and Opinion Research For contests, we use your data for the purpose of notifying winners and advertising our offers. Detailed information can be found in our terms and conditions for each respective contest. We also use your data for market and opinion research. Naturally, we use this information exclusively in anonymized form for statistical purposes and only for JPB. Your survey responses will not be passed on to third parties or published. We do not store the responses from our surveys together with your email address or other personal data. I consent to JPB processing and using my personal data for market and opinion research for its own purposes. You can object to the use of data for market and opinion research at any time, either in full or for specific measures, without incurring other than transmission costs at basic rates. A written communication to the contact details mentioned under Clause 1 (e.g., email, fax, letter) is sufficient for this purpose. Of course, you will also find an unsubscribe link in every survey email.

  1. Credit Check To offer you the best payment options, we need to protect both you and ourselves from misuse. Therefore, we transmit the personal data required for a credit check, including your address data, to CRIF GmbH (formerly Deltavista GmbH Österreich), Diefenbachgasse 35/1, 1150 Vienna. CRIF GmbH performs an assessment based on mathematical-statistical procedures. Your address data is also included in the calculation of the probability value. We use the information received about the statistical probability of payment default (“probability value”) to make a balanced decision about the payment options available to you. If you disagree with the payment method(s) offered to you based on this automated process, you can notify us in writing. We will then reevaluate the decision, taking your viewpoint into account. You can object to the transmission of your data to Bürgel at any time. A written communication in text form (e.g., email, fax, letter) is sufficient for this purpose. However, please note that in this case, only the prepayment option is available to you.
  2. Cookies Accepting cookies is not a prerequisite for visiting our websites. However, please note that the use of the shopping cart function and the order of products is only possible if you allow us to set cookies.

What are Cookies? Cookies are small files stored on your hard drive that save specific settings and data for exchanging with our system through your browser. Generally, two different types of cookies are distinguished: session cookies, which are deleted as soon as you close your browser, and temporary/permanent cookies, which are stored on your hard drive for a longer period or indefinitely. This storage helps us design our websites and offers for you accordingly and makes it easier for you to use them by, for example, saving certain inputs so you don’t have to repeat them constantly.

What Cookies does JPB use? Most of the cookies we use are automatically deleted from your hard drive after the end of the browser session (end of the session) (hence session cookies). Session cookies are needed, for example, to offer you the shopping cart function over multiple pages. We also use cookies that remain on your hard drive. On your next visit, it will be automatically recognized that you have been with us before and which inputs and settings you prefer. These temporary or permanent cookies (lifespan 1 month to 10 years) are stored on your hard drive and delete themselves after the specified time. In particular, these cookies serve to make our offer more user-friendly, effective, and secure. Thanks to these files, it is possible, for example, that you see information on the page that is specifically tailored to your interests. The sole purpose of these cookies is to adapt our offer to your customer wishes as best as possible and to make your surfing with us as comfortable as possible.

What Data is Stored in the Cookies? No personal data is stored in the cookies used by JPB. The cookies we use are not assigned to any specific person and are therefore not attributable to you. When the cookie is activated, it is assigned an identification number. Assignment of your personal data to this identification number is not possible at any time and is not performed. Your name, IP address, or similar data that would enable the assignment of the cookie to you is not recorded at any time. Based on cookie technology, we only receive pseudonymized information, such as which pages of our shop were visited, which products were viewed, etc.

What is Onsite Targeting? On the JPB website, data is collected using cookie technology for the optimization of our advertising and the entire online offering. This data is not used to personally identify you but serves solely for a pseudonymous evaluation of the homepage’s usage. Your data is never merged with the personal data stored with us. With this technology, we can present you with advertising and/or special offers and services based on information obtained from clickstream analysis (for example, advertising that is targeted to pages viewed exclusively in the last few days, such as sports shoes). Our goal is to make our online offering as attractive as possible for you and to present advertising that corresponds to your interests.

Are There also Cookies from Third Parties (so-called Third-Party Cookies)? JPB uses some advertising partners to help make the Internet offering and the websites more interesting for you. Therefore, when you visit the websites, cookies from partner companies are also stored on your hard drive. These are temporary/permanent cookies that are automatically deleted after the specified time. These temporary or permanent cookies (lifespan 14 days to 10 years) are stored on your hard drive and delete themselves after the specified time. Cookies from our partner companies also do not contain personal data. Only pseudonymous data is collected under a user ID. This includes, for example, information about which products you viewed, whether anything was purchased, which products were searched for, etc. Some of our advertising partners also collect information beyond the websites about which pages you visited before or which products you were interested in, for example, to display advertising that best corresponds to your interests. These pseudonymous data are never merged with your personal data. They serve exclusively to enable our advertising partners to address you with advertising that might genuinely interest you.

Re-Targeting Our websites use so-called re-targeting technologies. We use these technologies to make the Internet offering more interesting for you. This technique allows us to address Internet users who have already shown interest in our shop and our products with advertising on the websites of our partners. We are convinced that the display of personalized, interest-based advertising is generally more interesting for Internet users than advertising that has no such personal reference. The display of these advertising materials on our partner’s pages is based on cookie technology and an analysis of previous user behavior. This form of advertising is completely pseudonymous. No personal data is stored, and usage profiles are also not merged with your personal data.

I consent to the use of so-called cookies and the collection, storage, and use of usage data by me. Furthermore, I consent to my data being stored in cookies beyond the end of the browser session and, for example, being accessed again during my next visits to the websites. I can revoke this consent at any time with effect for the future by refusing to accept cookies in my browser settings.

How Can I Prevent the Storage of Cookies? In your browser, you can set it to only accept the storage of cookies if you agree. If you only want to accept JPB cookies but not the cookies of our service providers and partners, you can select the setting in your browser to “block third-party cookies.” In the menu bar of your web browser, the help function usually shows you how to reject new cookies and disable already received ones. Detailed information on how to adjust the settings in the browser you are using can be found at the following link. We recommend that you always completely log out on shared computers that are set to accept cookies and flash cookies after use.

  1. Log Files Whenever you access the pages of JPB, usage data is transmitted by your respective internet browser and stored in log files, known as server log files. The data records stored include the following information: date and time of access, name of the accessed page, IP address, referrer URL (origin URL from which you accessed the websites), transmitted data volume, and product and version information of the used browser. User IP addresses are deleted or anonymized after the end of use. During anonymization, IP addresses are altered in a way that individual details about personal or factual circumstances can no longer be attributed to a specific or identifiable natural person, except with a disproportionate amount of time, cost, and effort. We analyze these log file records in anonymized form to improve and make the JPB website and shop more user-friendly, identify and fix errors faster, and manage server capacities. For example, we can track when the use of the JPB shop is particularly popular and allocate sufficient data volume to ensure a fast shopping experience.
  2. Google Analytics Google Analytics is a service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). Google Analytics uses “cookies,” text files stored on your computer, enabling Google to analyze the use of our offering. Information captured by the cookie about the use of our websites (including your IP address) is generally transmitted to and stored on a Google server in the USA. We want to highlight that on our websites, Google Analytics has been extended with the code “gat._anonymizeIp();” to ensure the anonymized collection of IP addresses (so-called IP masking). Your IP address is therefore only collected by Google in a shortened form at our request, ensuring anonymization and preventing conclusions about your identity. In case of IP anonymization activation on this website, your IP address will be truncated by Google within member states of the European Union or other contracting states of the European Economic Area before transmission. Google also adheres to the privacy regulations of the “US Safe Harbor” agreement and is registered with the US Department of Commerce’s “Safe Harbor” program. Google will use the mentioned information to evaluate your use of our websites, compile reports on website activities for us, and provide further services related to website and internet usage. The IP address transmitted by your browser within Google Analytics is not merged with other Google data. Google only transfers this data to third parties based on legal regulations or within the scope of order data processing. Under no circumstances will Google combine your data with other data collected by Google. By using these websites, you consent to the processing of data about you by Google in the manner and for the purposes set out above. You can prevent the storage of cookies by adjusting your browser software settings; however, please note that in this case, you may not be able to use all functions of these websites to their full extent. Additionally, you can prevent Google from collecting and processing the data generated by the cookie related to your use of the websites (including your IP address) by downloading and installing the browser plugin available at the following link: Google Analytics Opt-out Browser Add-on. For more information on Google Analytics and privacy, please visit Google Analytics.
  3. Doubleclick by Google Doubleclick by Google is a service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). Doubleclick by Google uses cookies to present you with relevant advertisements. Your browser is assigned a pseudonymous identification number (ID) to check which ads were displayed in your browser and which ads were accessed. The cookies do not contain personal information. The use of DoubleClick cookies allows Google and its partner websites to display ads based on previous visits to our or other websites on the internet. The information generated by the cookies is transmitted to and stored on a server in the USA. Google adheres to the privacy regulations of the “US Safe Harbor” agreement and is registered with the “Safe Harbor” program of the US Department of Commerce. Google only transfers data to third parties based on legal regulations or within the scope of order data processing. Google will not combine your data with other data collected by Google. By using these websites, you consent to the processing of data about you by Google in the manner and for the purposes set out above. You can prevent the storage of cookies by adjusting your browser software settings; however, please note that in this case, you may not be able to use all functions of these websites to their full extent. Additionally, you can prevent Google from collecting and processing the data generated by the cookies related to your use of the websites by downloading and installing the browser plugin available at the following link: DoubleClick Deactivation Extension. Alternatively, you can disable Doubleclick cookies on the Digital Advertising Alliance page at the following link: About Ads Choices.
  4. Social Plugins Our website uses social plugins (“plugins”) from various social networks. With the help of these plugins, you can share content or recommend products. The plugins are deactivated by default on JPB.at and do not send any data. By clicking the “Activate Social Media” button, you can activate all plugins (so-called 2-click solution). When these plugins are activated, your browser establishes a direct connection with the servers of the respective social network as soon as you visit a page on our website. The content of the plugin is directly transmitted to your browser by the social network and integrated into the website. The plugins can be deactivated with a click. By integrating the plugins, the social network receives information that you have visited the corresponding page of our website. If you are logged into the social network, it can associate the visit with your account. If you interact with the plugins, such as clicking the Facebook “Like” button or leaving a comment, the corresponding information is directly transmitted from your browser to the social network and stored there. For the purpose and scope of data collection and further processing and use of data by social networks, as well as your rights and privacy settings, please refer to the privacy policies of the respective networks or websites. The links can be found below. If you do not want social networks to collect data about you through our website, you must log out of these networks before visiting our website. Even if you are not logged in to social networks, data may be sent to the networks from websites with active social plugins. An active plugin sets a cookie with an identifier on each website visit. Since your browser automatically sends this cookie to the network server with each connection, the network could, in principle, create a profile of the websites the user associated with the identifier has visited. It would then be possible to associate this identifier later – for example, when logging in to the social network – with a person. If you do not want social networks to collect data about you through active plugins, you can either simply deactivate the social plugins with a click on our websites or choose the “Block third-party cookies” function in your browser settings. This way, the browser does not send cookies to the server for embedded content from other providers. However, with this setting, some cross-site functions may no longer work besides the plugins.

  2. Rights of the Data Subject According to the Federal Data Protection Act, our customers have the right to free information about their stored data, as well as the right to correction, blocking, or deletion of data if necessary.
